These Terms of Service ("Terms") govern your access to and use of this website and your purchase of products from KBD & Partners LLC ("KBD," "we," "us," or "our"). By accessing this site or placing an order, you agree to be bound by these Terms. If you do not agree, you may not use the site or purchase from us. These Terms incorporate by reference our Privacy Policy and our Return & Refund Policy. Our store is hosted by Shopify Inc., which provides the e-commerce platform through which we sell to you.
This site and the products sold on it are intended exclusively for adults 18 years of age or older. By using this site or placing an order, you represent that you are at least 18 and meet the legal age of majority in your jurisdiction. We reserve the right to cancel any order and restrict access where we have reason to believe the user is underage. Misrepresenting your age to use this site or purchase our products violates these Terms and may violate applicable law.
Our products are intended solely for safe, sane, and consensual use between informed adults. Many of our products — including restraints, bondage gear, gags, wearable items, and impact accessories — carry inherent risks and may cause serious injury if used improperly, and in some cases even when used as intended. You agree to read all product information and any included safety guidance before use; to use products only with the informed, ongoing, and freely given consent of everyone involved; to never use restraint or breath-affecting products on a person who is unsupervised, impaired, or unable to communicate; and to discontinue use immediately if a product shows wear or damage or if anyone experiences distress, numbness, or pain. If you are new to these products, we strongly encourage you to research established safety practices before use. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence.
All orders are offers to purchase and are subject to our acceptance and to product availability. We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, suspected resale or distribution, ordering limits per person or household, or errors in product or pricing information. A contract is formed only when we confirm acceptance of your order. Prices are subject to change without notice. If a product is listed at an obviously incorrect price due to a typographical or system error, we may cancel the order even after it is placed; if it has not yet shipped, we will contact you to confirm the corrected price or cancel and refund it.
You agree to provide current, complete, and accurate purchase and account information, and to keep it updated (including your email, shipping address, and payment details) so we can complete your orders and contact you as needed.
We take fraud seriously and use reasonable measures, including third-party fraud-screening services, to detect and prevent fraudulent transactions. We may decline or cancel orders, and may share relevant information with fraud-prevention agencies, where we reasonably suspect fraudulent activity.
We make every effort to display product colors, images, dimensions, and descriptions accurately, but we cannot guarantee that your device's display will render colors accurately, and we do not warrant that descriptions or other content are error-free. Please review product details — including measurements and any sizing guidance — carefully before ordering.
Content on the site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. If you send us reviews, ideas, suggestions, or other materials ("Submissions"), you grant us a non-exclusive, royalty-free, perpetual right to use, edit, publish, and distribute them in any medium without compensation or obligation of confidentiality. You represent that your Submissions are your own, do not violate anyone's rights, and contain nothing unlawful, abusive, defamatory, obscene, or malicious. We may, but are not obligated to, monitor or remove content at our discretion.

To the fullest extent permitted by applicable law, KBD and its members, officers, employees, agents, suppliers, and service providers will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost data, or replacement costs, arising out of or related to your use of the site or our products, whether based in contract, tort, or any other theory, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the site or a product will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence or for fraud. Because some jurisdictions do not allow certain limitations, some of the above may not apply to you, and our liability will be limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless KBD and its members, officers, employees, agents, contractors, suppliers, and service providers from any claims, demands, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or any incorporated policy, your violation of any law or third-party right, or your use or misuse of our products.
These Terms remain in effect while you use the site. We may suspend or terminate your access at any time, without notice, if we believe you have violated these Terms. You may terminate by ceasing to use the site. Obligations that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.
These Terms and any dispute arising out of them or your use of the site are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules, except as otherwise required by mandatory consumer-protection laws of your place of residence.
Good-faith negotiation. Before initiating arbitration, you agree to first contact us in writing describing the dispute and the relief you seek, and the parties will attempt in good faith to resolve it for thirty (30) days.
Binding arbitration. If the dispute is not resolved, you and KBD agree it will be resolved by binding, individual arbitration administered by the American Arbitration Association under its applicable consumer rules, rather than in court. The arbitrator's decision is final and may be entered as a judgment.
Jury and class-action waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND KBD WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Exceptions. Either party may bring an individual claim in small claims court where eligible, or seek injunctive relief in a court of competent jurisdiction to protect intellectual property or in aid of arbitration. If the class-action waiver is found unenforceable, the remainder of this arbitration section will not apply to that dispute.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, epidemics or pandemics, war or terrorism, civil unrest, labor disputes, carrier failures, or governmental action. Our obligations are suspended for the duration of the event.
If any provision of these Terms is found unlawful or unenforceable, it will be severed and the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of it. We may assign our rights and obligations under these Terms; you may not assign yours without our written consent.
These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and KBD regarding the site and supersede any prior agreements. Any ambiguity will not be construed against the drafting party.
We may update these Terms from time to time. Material changes will be announced by email to active customers and reflected on this page with an updated date at the top. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.
